Terms of Use

1. Introduction and Acceptance

These Terms of Use (“Terms”) govern access to and use of the NED Connect platform (“Platform”), operated by the National Association for Social Change Entities in Education (NASCEE).

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

2. Purpose of the Platform

NED Connect is designed to:

  • Provide visibility into organisations, programmes, and services across the education sector

  • Enable coordination, collaboration, and knowledge sharing

  • Support stakeholders including government, funders, and civil society

NASCEE acts solely as a neutral convenor and facilitator and does not:

  • Endorse organisations, programmes, or services

  • Verify all information submitted to the Platform

  • Act as a party to any collaboration, funding arrangement, or agreement between users

3. User Accounts and Authority

By creating an account, you warrant that:

  • You are authorised to act on behalf of your organisation (where applicable)

  • The information you provide is accurate and complete

You are responsible for:

  • Maintaining the confidentiality of your login credentials

  • All activity conducted under your account

4. User Responsibilities and Content Submission

4.1 Accuracy and Authority

You agree that:

  • All information submitted is accurate, current, and not misleading

  • You have the necessary rights, permissions, and consents to submit such information

4.2 Responsibility for Content

You remain solely responsible for all content you submit, including:

  • Organisation profiles

  • Contact information

  • Programme and service data

5. Data Visibility and Public Information

You acknowledge and agree that:

  • Certain information submitted to the Platform is intended to be publicly accessible

  • This may include organisation-level information such as:

    • Name, location, services, programmes, and geographic reach

Where personal information is included:

  • It must be limited to appropriate contact details

  • You confirm that you have obtained the necessary consent to share such information

NASCEE:

  • Does not control how publicly available data is used by third parties

  • Is not responsible for downstream use of such information

Information made publicly available through NED Connect may be accessed and used by government, funders, researchers, and other stakeholders for planning, coordination, and decision-making purposes.

6. Permitted Use of the Platform and Data

You may use the Platform and its data solely for:

  • Collaboration and partnership development

  • Sector planning and coordination

  • Research and insight generation

7. Prohibited Use

You must not:

  • Use the Platform or its data for unsolicited marketing, spam, or commercial solicitation

  • Engage in data scraping, automated extraction, or bulk downloading of Platform data

  • Use Platform data in a way that is misleading, harmful, or exploitative

  • Misrepresent your identity, organisation, or intentions

  • Interfere with the security or functionality of the Platform

NASCEE reserves the right to monitor usage and take action where misuse is suspected.

8. Intellectual Property

All rights, title, and interest in and to the Platform (including design, structure, and underlying systems) are owned by NASCEE or its licensors.

Users:

  • Retain ownership of the content they submit

  • Grant NASCEE a non-exclusive, royalty-free licence to use, display, and share such content for the purposes of operating the Platform

9. Data Use Disclaimer

You acknowledge that:

  • Information on the Platform is submitted by users and may not be independently verified

  • NASCEE does not guarantee the accuracy, completeness, or reliability of such information

Any reliance on Platform data is at your own risk.

10. Platform Availability

The Platform is provided on an “as is” and “as available” basis.

NASCEE does not guarantee:

  • Continuous or uninterrupted access

  • That the Platform will be error-free

11. Limitation of Liability

To the maximum extent permitted by law:

NASCEE shall not be liable for:

  • Any direct, indirect, incidental, or consequential loss arising from use of the Platform

  • Decisions made based on Platform data

  • Errors, omissions, or inaccuracies in user-submitted content

  • Loss arising from third-party use of publicly available information

12. Indemnity

You agree to indemnify and hold harmless NASCEE, its employees, and partners from any claims, damages, or losses arising from:

  • Your use of the Platform

  • Your submitted content

  • Your breach of these Terms

  • Any violation of applicable laws or third-party rights

13. Privacy and Data Protection

Personal information is processed in accordance with the Protection of Personal Information Act and the NED Connect Privacy Policy.

By using the Platform, you consent to such processing.

14. Suspension and Termination

NASCEE reserves the right to:

  • Suspend or terminate access to the Platform

  • Remove or modify content

  • Restrict access where misuse, risk, or breach is identified

15. Changes to Terms

NASCEE may update these Terms from time to time.

Continued use of the Platform constitutes acceptance of the updated Terms.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of South Africa.

Any disputes shall be subject to the jurisdiction of South African courts.
